1. Agreement to these terms

These Terms and Conditions ("Terms") are an agreement between you and the operator of Appster ("Appster," "we," "us," or "our"). They apply when you visit our website, create an account, or use Appster (together, the "Service"). By doing any of those, you agree to these Terms. If you don't agree, don't use the Service.

If you're agreeing for a company, you confirm you're authorized to bind it, and "you" means that company.

2. What Appster is

Appster hosts code and content that you write, and serves it to the websites where you place an Appster Tag. You can publish JavaScript, CSS, HTML, values, and functions, keep versions of each, and change what a tag serves without editing the site it's embedded in.

Appster is a tool. It doesn't write your code for you, and it doesn't check that what you publish is correct, lawful, or safe for the site it reaches.

3. Your account

• You need an account to use the Service, and the details you give us must be accurate.
• You're responsible for everything done through your account, including by teammates and clients you invite, and by any AI service you connect to it.
• Keep your password and API credentials to yourself. Tell us promptly if you think someone else has them.
• You must be at least 18, or the age of majority where you live.

4. Plans, payment, and renewal

• The Free plan is free, and we may change or end it with reasonable notice.
• Paid plans are billed in advance through PayPal at the price shown when you subscribe, and they renew automatically for the same period until you cancel.
• Prices can change. We'll tell you before a change applies to your next renewal.
• Prices exclude taxes unless we say otherwise. You're responsible for any taxes that apply to you.
• Refunds: payments are not refunded, except where the law where you live gives you a right to one. You can cancel at any time and keep the paid features until the end of the period you paid for.
• If a payment fails, we may suspend paid features until it clears.

5. Cancelling, and what happens to your tags

You can cancel at any time from your account. Cancelling stops the next renewal; it doesn't refund the period you've already paid for unless the refund line above says so.

Read this part carefully. The sites you build depend on Appster serving what their tags ask for. When an account is closed, downgraded past its limits, or suspended, those tags can stop serving, and the pages that rely on them will lose whatever the tag provided. Before you cancel, export what you need and remove or replace the tags on any live site.

Cancelling a paid plan doesn't delete anything: your content stays in your workspace, under the limits of the plan it moves to. When you delete a code or a whole workspace, it is removed from the live service straight away and we can't restore it. Copies may remain in routine backups for a short time before they are overwritten.

6. Your code and content

Everything you publish through Appster, including code, values, and files, stays yours. You give us the permission we need to host it, store versions of it, and serve it to the sites where your tags are placed, so that we can run the Service for you.

You promise that you have the right to publish what you publish, and that it doesn't infringe anyone else's rights.

7. Acceptable use

Don't use Appster to publish or run:

• malware, crypto miners, or anything that damages, hijacks, or takes over a visitor's browser or device;
• code that collects personal information without the site owner's knowledge and the visitor's consent where consent is required;
• content that is unlawful, infringing, deceptive, or that you have no right to distribute;
• anything that attacks other systems, sends spam, or hides what it does from the site owner;
• traffic or workloads designed to overload the Service, or attempts to get around plan limits, access controls, or security.

We may remove content or suspend an account that breaks this section, and we'll tell you why when we can.

8. The sites where you place tags

You decide which sites carry your tags, so:

• you must have the site owner's permission to place a tag and to change what it serves;
• you're responsible for telling your clients that a third-party service serves part of their site, and for the privacy notices their visitors are shown;
• you're responsible for what your code does to their visitors, including any data it collects and any cookies it sets;
• turning a tag off changes what a live site shows. Whether you may do that, and when, is between you and your client, so make sure your own agreement with them covers it;
• between you and us, you are the controller of the personal data your code handles on those sites, and we act on your instructions. Our privacy policy explains what we receive when a tag is loaded.

9. AI features and API access

Appster can be connected to outside AI services, such as Claude or ChatGPT, which can then read, change, and publish what is in your workspace. It can also write short summaries of versions if you add your own AI provider key. If you use either:

• drafts are suggestions. Review them before publishing, the same as code from anyone else.
• what an AI service reads from your workspace is processed by that service, under your own account with it and its terms. Don't put passwords, API keys, or personal data where it will read them.
• anything an AI service publishes through your API credentials counts as published by you, and you're responsible for it.
• API credentials are yours to protect, and you can revoke them at any time.

10. Webhook functions

Functions run code on our infrastructure and return a URL that anyone with the URL can call. You're responsible for what your functions do, for keeping their URLs and secrets private, and for the traffic they attract. Fair use applies: we may rate-limit or suspend a function that destabilises the Service, and we'll contact you when we do.

11. Versions are not a backup service

Appster keeps versions of what you publish so you can look back and roll back. That's a product feature, not a backup service, and we don't promise any particular number of versions or retention period beyond what your plan describes. Keep your own copies of anything you can't afford to lose.

12. Appster Hosting (private beta)

Appster Hosting is in private beta. Beta features are provided as they are, may change or be withdrawn, and may have interruptions that the rest of the Service doesn't. Don't put a site on it that you can't move somewhere else. If we end the beta or change how it works, we'll give you reasonable notice and a way to export your content.

13. Availability and support

We work to keep Appster available and fast, and figures such as typical publish times describe normal performance rather than a promise. We don't offer an uptime guarantee unless we've signed a separate written agreement with you. We may carry out maintenance, and we'll try to do it at quiet times.

Support is by email at [email protected]. We read it on business days and aim to reply within two of them.

14. Third-party services

Appster works alongside services we don't control, including GoHighLevel, WordPress, Webflow, PayPal, and any AI service you connect. We're not affiliated with them, and their terms and privacy policies apply to your use of them. If one of them changes or breaks something, we'll do what we reasonably can, but we're not responsible for their acts.

15. Our intellectual property

Appster, including the software, the dashboard, our name, and our branding, belongs to us. These Terms give you the right to use the Service, not to copy, resell, reverse-engineer, or rebuild it.

16. Feedback

If you send us ideas for improving Appster, we can use them without owing you anything for them.

17. Suspension and termination

You can close your account at any time. We may suspend or close an account that breaks these Terms, doesn't pay, or puts the Service or other customers at risk. Unless the situation is urgent or unlawful, we'll give you notice and a chance to fix it first. Section 5 explains what happens to your tags when an account ends.

18. Disclaimers

The Service is provided "as is" and "as available". To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted or error-free, or that code you publish through it will work as you intend on every site.

19. Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, or USD 100 if you paid us nothing.

Nothing in these Terms limits liability that can't be limited by law.

20. Indemnification

You'll defend and indemnify us against claims, damages, and reasonable costs arising from the code and content you publish, from the sites where you place tags, or from your breach of these Terms.

21. Changes

We may change the Service and these Terms. If a change is significant, we'll tell you in the app or by email before it takes effect. Continuing to use Appster after a change means you accept the updated Terms. The date at the top shows when these Terms last changed.

22. Governing law and disputes

Let's try to sort a problem out by email first: [email protected]. If that doesn't settle it, these Terms are governed by the laws of the place where the operator of Appster is established, without regard to conflict-of-law rules, and the courts of that place have jurisdiction, except that either party may seek an injunction anywhere to protect its intellectual property. If you're a consumer, this doesn't take away any protection the law of your own country gives you.

23. General

• Entire agreement. These Terms are the whole agreement between us about the Service.
• Severability. If part of these Terms can't be enforced, the rest still applies.
• No waiver. Not enforcing a right isn't giving it up.
• Assignment. You can't transfer these Terms without our consent. We may transfer them as part of a merger or sale of our business.
• Events beyond control. Neither party is liable for delays caused by events beyond its reasonable control.
• Notices. We'll send notices to the email on your account. Send yours to the address below.
